The use of the web pages offered by DICO Deutsches Institut für Compliance e. V. is permitted exclusively on the basis of these conditions. Please read the following terms carefully before first use. Due to current developments, it may be necessary to adjust the conditions at any time. Please visit this page before re-opening the web pages to find out about any changes. The following Terms of Use apply to the use of the DICO websites in the relationship between the user and DICO as the operator of the website.

 

2. Services

DICO makes certain information, files or documents available on its websites for retrieval or downloading. The entire content of the DICO website is protected by copyright. Downloading or printing out individual pages and/or sections of the DICO Website is only permitted insofar as it is covered by the purpose made available and provided with a reference to the DICO Homepage. Copyright notices may not be removed or changed. Any reproduction, transmission or editing outside the limits of copyright law without the prior consent of DICO is prohibited.

DICO is entitled to stop the operation of all or part of the websites at any time. Due to the nature of the Internet and computer systems, DQS accepts no liability for the uninterrupted availability of the websites.

DICO’s web pages may contain hyperlinks to the web pages of third parties. DICO neither assumes responsibility for the contents of these websites nor does DICO adopt these websites and their contents as its own, as it does not control the linked information and is also not responsible for the contents and information provided there. 4. Liability for legal and material defects

Insofar as information, files or documents are provided free of charge, liability for defects as to quality and title of the information, files and documents, in particular for their correctness, freedom from errors, freedom from third-party industrial property rights and copyrights, completeness and/or usability – except in cases of intent or fraudulent intent – is excluded.

 

5. Other liability, viruses

5.1

DICO’s liability for material defects and defects of title shall be governed by the provisions in Clause 8 of these Terms of Use. For the rest, any liability of DICO is excluded, unless, for example, liability is mandatory under the Product Liability Act, due to intent, gross negligence, injury to life, body or health, due to the assumption of a quality guarantee, due to fraudulent concealment of a defect or due to the violation of essential contractual obligations. However, damages for breach of material contractual obligations shall be limited to the foreseeable damage typical for the contract, unless caused by intent or gross negligence.

5.2
Although DICO makes every effort to keep the web pages free of viruses, Trojans and other harmful proactive systems, DICO does not guarantee this. Before downloading information or data, the user must ensure appropriate security measures and virus scanners for his own protection and to prevent viruses on the DICO website.

5.3
The activation of certain links on the DICO website may lead to the user leaving the DICO website. DICO cannot continuously check the links and the content of the linked pages and assumes no liability for their technical quality or for their content, in particular the products, services or other offers offered on them.

A change of the burden of proof to the disadvantage of the user is not connected with the above regulations.

 

6. Data protection and data security

When collecting, using and processing the user’s personal data, DICO observes the applicable data protection regulations. The user expressly agrees to the electronic data processing by sending the data. The user has the right to revoke his consent at any time with effect for the future. Furthermore, the user is entitled to inspect the existence and scope of his stored data after written notification to DICO. 6.2
DICO points out that, as a public communication system on the Internet, security gaps can arise at any time that were not known before they occurred and did not have to be known according to the state of the art. DICO will take the necessary defensive measures after knowledge and examination of security gaps.
